Property Law

Property law is an important legal arrangement that protects individuals or legal entities that own personal or fixed property.

• Buying or Selling property is the biggest financial commitment most of us will ever undertake.
• The Estate Agent will explain the terms of the sale agreement to the parties – who must ensure that they ask questions and understand all the terms before signing the agreement.
• Once the agreement of sale is signed, it is a binding contract between the Seller and Purchaser.

Notarial Agreements
Agreements to be executed before a notary by law, certain documents are expected to achieve greater certainty.

These are:

• Authentication documents.
• Antenuptial contracts, Postnuptial contracts.
• Certain documents relating to the transfer of property, ie servitudes.
• Certain forms of security or sessions are also executed in the presence of a notary and registered in the deeds office.

Estates

Reporting documents will differ slightly depending on the value of the estate and the type of appointment. If the value of the estate exceeds R250 000, letters of executorship must be issued and the full process prescribed by the Administration of Estate Act must be followed.

However if the value of the estate is less than R250 000, the Master may dispense with letters of executorship, and issue letters of authority in terms of section 18(3) of Administration of Estates Act, 66 of 1965. Letters of authority entities the nominated representative to administer the estate without following the full procedure set out in the Administration of Estates Act.
