Services:

  • Property Law & Conveyancing:

Conveyancing is the process that refers to the transfer of legal title of property from one person to another. It is the Seller’s prerogative as to appoint and instruct a transferring attorney to undertake the registration of immovable property process, however can be varied by agreement between the Seller and Purchaser.  There are usually three attorneys involved in the transfer process, namely the transferring attorney, the bond cancellation attorney and the bond registration attorney.

They will assist you with the transferring of a property as quickly and effectively as possible, whilst attention to detail ensures that the high standards of accuracy expected in the registration process are achieved.   • Deceased Estates:

  • Antenuptial Agreements:

An Antenuptial Agreement is a written contract between two people who are about to marry, setting out the terms of possession of assets, treatment of future earnings, control of the property of each and potential division if the marriage is later dissolved.  It is one of the most important documents that you will sign in your lifetime. The Antenuptial Agreement must be signed before the marriage is concluded. The contract must be registered in the Deeds Office within 3 months from date of signature. If the parties conclude a marriage without signing a prenuptial agreement the marriage will by default be regarded as in community of property.  It will be possible to change the matrimonial property regime after date of marriage. Section 21(1) of the Matrimonial Property Act 88 of 1984 makes provision for a couple to apply to the High Court to change their marital regime and to register a postnuptial agreement.  

There are two variations of Antenuptial contracts, namely

  • Out of community of property subject to the accrual system
  • Out of community of property excluding the accrual system
