Conveyancing is the process that refers to the transfer of legal title of property from one person to another. It is the Seller’s prerogative as to appoint and instruct a transferring attorney to undertake the registration of immovable property process, however can be varied by agreement between the Seller and Purchaser.  There are usually three attorneys involved in the transfer process, namely the transferring attorney, the bond cancellation attorney and the bond registration attorney.

They will assist you with the transferring of a property as quickly and effectively as possible, whilst attention to detail ensures that the high standards of accuracy expected in the registration process are achieved. Their conveyancing department is committed to regular and effective communication to ensure that the attorney and client relationship is one of trust and satisfaction.

  • Deceased Estates:

The death of a loved one is a very traumatic and emotional time for families and few are equipped to cope with all the legal and financial consequences of death.  The administration of deceased estates is often a lengthy and complex process requiring the services of skilled professionals with sound working knowledge and expertise. One of the most important things in the winding up of an estate is appointing an executor who you and your family members can trust and who will finalise the estate in an efficient yet empathetic manner. Entrust your legacy and loved ones in the hands of their experienced firm for excellent service that will not only meet but exceed your expectations.

  • Last Wills & Testaments:

A last Will and Testament is a specialized document that details how a person’s estate should be distributed upon passing away. Most people regard the drafting of a Will as a bothersome exercise and often procrastinate when attending thereto. It is of utmost importance that their clients take the time to draw up this vital document that allows them to communicate their wishes and make things easier for their loved ones.  Creating a last Will and Testament will also ensure that you nominate a credible and trustworthy executor who will be able to protect you and the interests of your family. It is imperative that you review your last Will and Testament upon the occurrence of specific life events for example, marriage, divorce or the birth of a child. Yolanda Barnard Attorneys will be able to assist you with the drafting or revision of your last Will and Testament according to your instructions and wishes, ensuring that the document is valid, legally compliant and enforceable.

  • Antenuptial Agreements:

An Antenuptial Agreement is a written contract between two people who are about to marry, setting out the terms of possession of assets, treatment of future earnings, control of the property of each and potential division if the marriage is later dissolved.  It is one of the most important documents that you will sign in your lifetime. The Antenuptial Agreement must be signed before the marriage is concluded. The contract must be registered in the Deeds Office within 3 months from date of signature. If the parties conclude a marriage without signing a prenuptial agreement the marriage will by default be regarded as in community of property.  It will be possible to change the matrimonial property regime after date of marriage. Section 21(1) of the Matrimonial Property Act 88 of 1984 makes provision for a couple to apply to the High Court to change their marital regime and to register a postnuptial agreement.

There are two variations of Antenuptial contracts, namely

  • Out of community of property subject to the accrual system
  • Out of community of property excluding the accrual system

Yolanda Barnard Attorneys will be able to advise which marital property regime will best suit your needs and circumstances.
